Carry on using Win 8.1 VM after free upgrade to Windows 10?

I upgraded my Windows 8.1 to Windows 10 and it was automatically activated.

It seems the Windows 8.1 VM (which I kept a copy of before upgrade) still works and is activated.

Am I breaking the Microsoft License? If not why not? surely this is not Microsofts intent?

In Windows forums I read they can't both remain activated and sooner or later one will be flagged as not activated. Is Parallels legally different in some way?

    Thanks

Indeed, MS intent was that upgrading from Windows 8 to Windows 10 would be free, i.e. Windows 10 replaces Windows 8 for free.
This makes me think that if we duplicate the 8.1 VM and convert one to 10, thus having two activations we are actually not legal, even if it works.
